  • Notes
    • J. F. Byerly, THE BYERLY FAMILY OF THE VALLEY OF VIRGINIA, p. 33 (1994), says:
"The oldest son, Joseph II, (1766-1837) (m) Catherine Landis. Catherine was the daughter of John Landis who came from York Co., Pennsylvania in 1790...."

      At p. 41, Byerly continues:
"Joseph II, a millwright and farmer, was b. 20 Apr. 1766 d. 17 Dec. 1837 and is bur. on the Byerly farm at Pleasant Valley.... He was (m) (1) to Catherine LANDIS on 8 Nov 1796 by Rev. Benj. Irvin.... Joseph (m)(2) Sarah Meier BYERLY, the widow of his brother David.*** "

      C. E. May, LIFE UNDER FOUR FLAGS IN NORTH RIVER BASIN OF VIRGINIA, pp. 255-256 (1976), writes:
"Joseph Byerly, who lived on the north bank of North River about a mile downstream of McGills Ford, petitioned Rockingham County court September 11, 1811, for permission to build a dam across the river so he could secure the water power necessary to operate a grist-mill. The proposed dam would abut against one acre of George Koogler's land on the opposite bank of the stream.... [Koogler objected and commissioners were appointed to asses damages.] The commissioners found the site satisfactory and fixed damages to George Koogler at $23.
"James McGill, who owned land also on the south bank of the river near Koogler's and who operated a sawmill on it now objected to the comissioners' findings.... June 16, 1812, the county court nullified its commission's findings; whereupon Joseph Byerly appealed the case, and the appeals court granted him a writ of adquod damnum to condemn one acre of George Koogler's land...and appointed a new commission to view the site and to assess damages.... This commission recommended that the proposed dam be built, limited its height to 22 inches above the low water level and awarded George Koogler $25 damages.... [Others appealed] but April 21, 1813, the appeals court found in favor of Joseph Byerly. He built his mill, and he and his family operated it as Byerly's mill until the close of the Civil War, when it was purchased by George Berlin."
